Big-Rig Truck Strikes Pedestrian in San Francisco

On May 17, 2012, an accident claimed the life of a 45-year-old man. According to published reports, the victim has been identified as Sena Putra who recently immigrated to Oakland from Indonesia. This accident is another tragic reminder of the deadly consequences of commercial truck accidents.

The accident occurred at the intersection of 13th Street and Folsom in San Francisco at approximately 1:00 pm. This dangerous intersection is located beneath the Highway 101 overpass. A San Francisco Police Department spokesman indicated that the victim was struck by a gasoline tanker big-rig truck which was making a right turn on to 13th Street. The victim was reportedly in a crosswalk when he was struck by the big-rig truck. The victim was taken to a local hospital where he eventually succumbed to his injuries.

As seen here, negligence on the part of big-rig truck drivers can have deadly consequences. Driver inattention, inexperienced drivers, and aggressive driving are some of the leading causes of big-rig truck accidents. These dangers are heightened in urban environments where big-rig and commercial trucks are in close proximity to pedestrians and passenger vehicles. Any accident involving a big-rig truck can have fatal consequences due to the massive size and weight of the trucks.

The employers of drivers of big-rig and commercial trucks are required by law to take precautions to ensure the safety of others. Employers must conduct background checks before hiring drivers, verify that all drivers are in possession of a valid commercial driver license, and monitor the driving record of each employee annually. Employers must also enforce hours of service regulations in order to help alleviate the dangers associated with driver fatigue.

Additionally, employers are required by law to continually verify that all commercial trucks are in adequate physical and mechanical condition. Employers who fail to comply with these and other legal duties can be found negligent and held liable for injuries caused by their employee drivers.
