Southern California Tour Bus Crash Results in Eight Confirmed Fatalities

California authorities are investigating a devastating tour bus crash that occurred at 6:30 PM on Sunday February 3, 2013. According to published report, the scene of the accident was State Route 38 near Yucaipa, California south of the San Bernardino National Forest. Local residents refer to this stretch of State Route 38 near Mentone as Mill Creek Road.
The lettering on the bus that was involved in this tragic accident indicates that it was owned by a company based in National City, California called Scapidas Magicas LLC. Early reports indicate that the bus was chartered by the Tijuana based company InterBus Tours. The tour bus had reportedly departed from Tijuana, Mexico and was transporting passengers to and from Big Bear Mountain for a day of skiing.
Investigators have reported that the tour bus lost control and struck a car and a pickup truck before coming to rest on its side. Authorities immediately responded to the chaotic scene and began the difficult process of extracting the victims from the wreckage.
The scope of this tragedy is unimaginable. Preliminary reports indicate that at least eight victims suffered fatal injuries. Additionally, thirty-eight victims were reportedly transported to local hospitals with severe injuries. At Matiasic Roth & Johnson LLP our thoughts and prayers remain with all the victims and their families.
Early reports indicate that defective brakes on the tour bus may have contributed to this accident. The bus driver survived the accident and reportedly told investigators that the brakes malfunctioned as the bus was heading down the mountain.
Unfortunately, a failure to properly maintain buses and bus components is a common cause of bus accidents. Tour bus owners and operators who reduce maintenance expenses by cutting corners and compromising safety can be held responsible for any damages caused by their unsafe buses. The original manufacture of bus components may also share liability if defectively designed or manufactured components contributed to this bus accident.
Investigators have not yet determined if driver impairment or negligence contributed to this tragic accident. Some common types of bus driver negligence include: use of alcohol or drugs, speeding, inattention, aggressive driving and texting while driving. The driver and his employer can be held liable for this shocking accident if driver negligence was a contributing factor.
